SIM-PHONY warrants hardware products sold by it
to be in working condition from the date of shipment through various
periods as defined by the manufacturers' warranty. In addition,
SIM-PHONY enhances the manufacturers' warranty for products purchased
through SIM-PHONY
with a 24 Hour Advanced Replacement Guarantee, in case of product
failure during the deployment period, for certain components and
specified manufacturers. (See ADVANCED WARRANTY REPLACEMENT)
SIM-PHONY does not provide warranty on software
products. See software manufacturers' warranty for details. |
| Voice Component Product Warranty |
|
All voice products carry with them the
manufacturers' warranty as provided with the component or as posted on
the manufacturers' web site.
Warranty: One year, 18 months, 3
years and lifetime warranty, depending upon product purchased. This
specific warranty applies to all Dialogic, and CTL voice & integration
products sold separately or configured within any custom built or OEM
system. |
| Integrated Servers & Components |
|
SIM-PHONY warrants to Customers that the
integrated servers and components sold by it are free from defects in
material and workmanship under proper, normal use and service for a
period of one year from the date of shipment by SIM-PHONY.
SIM-PHONY will, at its
option, repair or replace failed or defective component parts or the
entire system at no charge to the customer. Replacement parts will be
the same or a later version, which perform substantially the same
function(s) as the one being replaced. In repairing any product under
this warranty, SIM-PHONY may use new, remanufactured, reconditioned,
refurbished, or functionally equivalent product or parts. Depot service
ONLY is available for full server warranty during this period. SIM-PHONY will make the final
determination as to the existence and cause of any defect. |
This warranty does NOT cover:
- Damage due to abuse, misuse, neglect, customer
modifications or accident;
- Improper wiring, repairing, splicing,
alternation, installation, storage or maintenance;
- Problems with electrical power;
- Usage not in accordance with product
instructions;
- Failure due to parts, components,
software products not supplied by SIM-PHONY.
- Products on which payment is past due.

| SIM-PHONY defines Dead On Arrival
("DOA") product to be "dead" or "not functional" within 30 days from
date of shipment. Customers have the opportunity to contact SIM-PHONY
Technical Support should their component or integrated server by DOA. It
is not uncommon for an integrated voice server to require a thorough
inspection to ensure all cables and cards, disrupted slightly during
shipping, are refastened PRIOR to booting the system for the first time
upon arrival. SIM-PHONY
Technical Support is available to assist the customer over the telephone
to make this inspection. |
| In the event component parts are
identified to be DOA during this period, SIM-PHONY Technical Support will administer the return of
defective parts in accordance with SIM-PHONY's Return Policy for DOA
product. SIM-PHONY Technical Support, at its option, will determine if
the entire server should be returned to SIM-PHONY under the DOA policy. |
| Subsequent to the 30 day DOA period, all faulty
components or integrated server returns are managed under SIM-PHONY's Return
Policy. |

No guarantee is made by
SIM-PHONY that third
party software can be installed and run uninterrupted and error free on
hardware purchased from SIM-PHONY. In addition, SIM-PHONY makes no warranty with
respect to defects related to Customer's software or database errors. |
| SIM-PHONY passes through to customer
warranties that SIM-PHONY
has received from the manufacturer of component parts. Such warranties
may exceed the length stated in SIM-PHONY's warranty and will be subject to
evaluation by the parts manufacturer prior to any warranty credit being
issued. |
| SIM-PHONY HEREBY PASSES THROUGH TO
ITS CUSTOMERS ONLY THOSE WARRANTIES RECEIVED BY IT FROM THE RESPECTIVE
MANUFACTURER TO THE PRODUCT. EXCEPT AS PROVIDED HEREIN, SIM-PHONY MAKES NO WARRANTY OR GUARANTEE
OF ANY KIND, EXPRESSED OR IMPLIED, INCLUDING ANY WARRANTY AS TO
MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR USE IS MADE UNLESS THE
SAME IS SPECIFICALLY SET FORTH IN THE MANUAL ACCOMPANYING THE PRODUCT
SOLD. UNDER NO CIRCUMSTANCES WILL STS BE LIABLE FOR ANY INCIDENTAL OR
CONSEQUENTIAL ECONOMIC OR PROPERTY DAMAGES ARISING OUT OF THE US OR
INABILITY TO USE THE PRODUCTS. |
| These terms, conditions, and warranties apply unless
the customer has signed a separate Agreement (On-Site Break & Fix for
Servers) or Statement of Work (SOW for Components), in which case the
Agreement or SOW shall govern. |
